Transportation and shipping risk

The formulation of an order, either in writing or verbally, made by the client or his representative, will imply acceptance of these general conditions of sale. The delivery times are indicative, we will not accept any penalty for damages as a result of delays in delivery.

As a general rule, the goods travel at the buyer's risk, always understanding, for all purposes, that the goods are delivered to the buyer at the seller's address.

Exceptions to this general rule when expressly agreed that the goods travel to "postage paid".

Claims & Returns

After receiving the products, the buyer must examine them without delay and with due diligence both in terms of quality and quantity.

Unless the buyer notifies the seller otherwise in writing within eight days of receipt of the products, they shall be deemed to have been duly received in the agreed amount and without deterioration. No return will be accepted without the prior written authorization of the seller.

The different shades that the product can present can not be object of claim since the supplied material is a natural product of vegetal origin and of artisan manufacture, that is why even in a same package the color may not be uniform. The tonalities and nuances of the samples are only indicative.

Unless otherwise specified in the contract, the seller can deliver 5% more or less than the agreed number of meters.

Under no circumstances claims about installed products will be accepted.

Form of payment of the sale price

It will be the form of payment that in each case is agreed in writing in the manner provided in the quote.

Payments will be considered made when they are completely and freely available to the seller. If the buyer does not satisfy the payment terms, it will be considered a serious breach of contract. Likewise, the seller will have the right to receive interest on late payments.

Unless otherwise agreed, in order to place any order, a percentage in advance of the deposit is required. In case of cancellation of the client, due to the custom and craft process of each order, the deposit will be used to cover the manufacturing and raw material costs.

All charges, fees, taxes and banking costs derived from the transfer of payments will be borne by the buyer.

Unless expressly indicated otherwise, the quotes will be valid for 30 days from the date of issue.

The buyer will not have the right to revoke or cancel any order once said order is in the possession of the seller, unless the seller has expressed in writing his agreement with said cancellation and has received from the buyer a written commitment to defray all costs, charges and expenses derived from said cancellation.

The client will not acquire the ownership of the products until he finishes paying the total price. While the buyer has not fully paid the price of the products will be simple depositary, and therefore, will lack disposition faculties, not being able to assign them or affect them to the payment of any other obligation. In case of failure to pay all or part of the price, the selling party will be entitled to enter where the products are stored and proceed to their withdrawal, thus recovering their material possession.

Jurisdiction

Both parties submit to the courts and tribunals of Guadalajara (Spain) renouncing to any jurisdiction that may correspond to them.
